Mehrere Jahre lang hat der inzwischen verstorbene Friedhelm Adolfs, Deutschlands bekanntester Raucher nach Helmut Schmidt, vor Gericht um den Verbleib in seiner Wohnung kämpfen müssen. Nachdem schließlich auch der Bundesgerichtshof die Urteile der Vorinstanzen kritisch durchleuchtet hatte und Substantielles daran zu bemängeln fand, wurde das Verfahren neu aufgerollt. Da nun endlich anstelle reiner Behauptungen der Vermieterseite Beweise geprüft und dem Urteil zugrunde gelegt werden mussten, gab es für Adolfs ein Happy End.
